Kenai District Court

The Kenai District Court handles civil and criminal matters and assists with marriage commissioner appointments. Any person 18 or older can be appointed as a commissioner for $25 to perform one ceremony in Alaska. The court falls under the Third Judicial District.

Requirements and Fees

All marriage licenses in Alaska come from the state through HAVRS. Both applicants must appear together with valid photo ID. Under AS 25.05.021, both must be sworn in and sign at the same time. Fee: $60 in person, $70 by mail. No blood test. No residency requirement. If either was divorced in the past 60 days, bring a certified copy of the final divorce decree. Alaska does not recognize common law marriage.

Waiting Period and Validity

The mandatory 3-day waiting period under AS 25.05.031 starts the day HAVRS issues the license. The ceremony cannot happen until at least three days after issuance. There is no waiver available. The license is valid for 90 days. If you miss that window, you have to start over. After the ceremony, the officiant must return the signed license to HAVRS within seven days. This seven-day deadline applies to all officiants, including marriage commissioners, clergy, and judges.

Who Can Perform the Ceremony

In Alaska, ordained or licensed clergy of any denomination can legally perform a marriage ceremony. Judges, magistrates, and justices of the peace also have authority. The marriage commissioner process at the Kenai District Court lets any adult 18 or older pay $25 to become a one-time commissioner. The appointment covers one ceremony anywhere in Alaska. Kenai is on Cook Inlet, and couples sometimes hold outdoor ceremonies at beach or waterfront locations. Alaska has no restrictions on ceremony location as long as a qualified officiant is present.

Certified Copies and Records

All Alaska marriage records from 1913 onward are maintained by HAVRS. Records are restricted for 50 years under Alaska Stat. 18.50.270. After that, they become public. Before the 50-year cutoff, eligible requesters include the parties to the marriage, their parents, adult children, siblings, and legal representatives. Order certified copies through VitalChek or by mailing a written request to HAVRS with both parties' full names, the marriage date, and the ceremony location. The fee is $30 for the first certified copy and $25 for each additional copy ordered at the same time.
